Proposed Women’s Reservation In Parliament Is Unconstitutional!

The Background: The Indian constitution was enacted on 26th of November, 1949. It is the supreme law of the land. It lays down the framework defining fundamental political principles, establishing the structure, procedures, powers and duties, of the government and spells out the fundamental rights, directive principles and duties of citizens. The constitution came into effect on January 26, 1950 and it guarantees among other things, equality before law and equality of opportunities through article 14 and 15, respectively.

The Constitution provides for a Parliamentary form of government which is federal in structure with certain unitary features. The constitutional head of the Executive of the Union is the President. As per Article 79 of the Constitution of India, the council of the Parliament of the Union consists of the President and two Houses to be known as the Council of States (Rajya Sabha) and the House of the People (Lok Sabha). Article 74(1) of the Constitution provides that there shall be a Council of Ministers with a Prime Minister as its head to aid and advise the President, who shall exercise his functions in accordance to the advice. The real executive power is thus vested in the Council of Ministers with the Prime Minister as its head.

The Council of Ministers is collectively responsible to the House of the People (Lok Sabha). Every State has a Legislative Assembly. Certain States have an upper House called State Legislative Council. Governor is the Head of a State. There shall be a Governor for each State and the executive power of the State shall be vested in him. The council of Ministers with the Chief Minister as its head advises the Governor in the discharge of the executive functions. The Council of the Ministers of a state is collectively responsible to the Legislative Assembly of the State.

Reservation for women: A demand was made by women’s groups for 33.3% reservation for women on the ground that their representation was low in parliament and state assemblies. The bill to reserve 33.3% of seats for women in legislative bodies was first drafted by the H D Deve Gowda-led United Front government. The Bill was introduced in the Lok Sabha [Lower house of Indian parliament]on September 12, 1996. Though it has been introduced in Parliament several times since then, the Bill could not be passed because of lack of political consensus.

What does the Bill provide?

Reservation for women at each level of legislative decision-making, starting with the Lok Sabha, down to state and local legislatures. If the Bill is passed, one-third of the total available seats would be reserved for women in national, state, or local governments. In continuation of the existing provisions already mandating reservations for scheduled caste and scheduled tribes, one-third of such SC and ST candidates must be women.

Failure of the 4th estate:

It is very sad and unfortunate that the Indian media has been taking the side and promoting the concept of reservation for women without ever, for once, showing the negative side of such a concept. By presenting news in such a way as though there were no negatives and that people have already accepted it, it has not been doing justice to the noble profession of journalism. In effect, the media has becoming a platform for one-sided, biased propaganda of certain vested interests and women’s lobbies without taking into consideration the rights and views of men and women who don’t support reservation and this discriminatory concept of “Robbing Peter To Pay Paul”. This bill is short-sighted, unconstitutional, undemocratic, and discriminatory. The following points are worth considering:

1. This Bill takes away the democratic right of 33% of the electorate (22 crore people) to elect their representatives. It restricts the choice of both men and women in those constituencies. The state has no right to limit the pool of representatives available to the public to choose from. This is against all democratic principles of free choice.

2. This takes away the democratic right of about 11 crore men to contest in elections, thus imparting a severe blow to the health of democracy in India . This is against the fundamental rights of 11 Crore men. It violates the right to equality guaranteed in the constitution.

3. It will lead to significant upheavals and instability in Indian polity, with MPs being forced to shuffle constituencies in almost every election. This would lead to an inability to nurture their constituency and further reduce accountability.

4. There are no measures to make sure that the benefits are received by the socially backward and underprivileged women, who really need them. There are no objective criteria to prevent the elite class or “creamy layer” of women from taking undue and unfair advantage of this legislation.

5. This Bill sacrifices merit and experience of seasoned law makers and will further divide the country on gender lines.

6. This bill suggests a rotation system which would be determined by draw of lots, in such a manner that a seat would be reserved only once in a block of three general elections. This is a serious flaw, insofar as it mechanically provides for entry of women members to fill one-third of vacancies in Lok Sabha and Vidhan Sabhas. This subverts the democratic process which is all about free choice vis-à-vis a mechanical action/ process.

7. The representation system in parliament and state legislatures is for entire constituencies which include every single person, be they man, woman or child and not just one section of the population within a constituency. In other words, an MP or an MLA is a public servant who represents a constituency and not any group/ section/ portion of his/ her constituency. He/ she is supposed to protect the interests of all in his/ her constituency and not just a particular group/ section/ portion in his or her constituency. This bill is against this concept of representation. The bill implies representation of women.

8. India is a vast country and is multi-cultural, multi-ethic, multi-lingual and with several groups, castes, sub-castes etc. The implementation of this bill would lead to more demands from various groups and sections of society for similar representation and it would be an open invitation for politicization of the representative form of Indian democracy. It will be a death blow to representation through constituencies.

9. The concept of reservation is an insult to women and their capability. This law perpetuates gender discrimination.

Rather than taking a judicious and considered approach towards the issue, which normally expected during the legislative process, the current Bill builds on gender stereotypes and makes several deeply flawed assumptions such as:

1. Women only vote for other women – More than 50% of the women exercised their franchise in the General Election of 2004 and elected their representatives, both men and women.

2. Forcing more women on the electorate is women empowerment – Forcing more women in the parliament through undemocratic means will only serve to undermine the legitimacy and efficacy of the elected women representatives.

3. All women are under-privileged - A gross generalization is made that all women are under-privileged, deprived and discriminated. That women are a homogenous group and there are no differences in terms of social status, education, etc. and hence, an across the board reservation system is needed.

4. All men are privileged - Similarly, a gross generalization is made that men are a homogenous group and are all privileged and have a natural advantage over women.

5. Women are advantaged - Assumption is made that women have no natural advantages over men. That society discriminates only women and not men. It does not recognize the natural and societal advantages that women have got in terms of moral superiority, greater faith and sympathy.

6. Reservation is indispensable - The bill does not recognize the fact that there have been many women who made it to high public offices and there have been many women Chief Ministers and a Prime Minister. Right now, we have a woman President. They all assumed office through their own efforts and without any reservation. The bill is based on the false assumption that women need reservation to enter high public offices.

The Conclusion:

It is very essential that facts are published in an unbiased manner and alternative views are considered by the media and the society. As the saying goes, “Robbing Peter to pay Paul”, is no solution - short term or long term for any perceived problem. Affirmative action creates a new set of problems than solving the existing problem.

The oppression of men is an extremely complex phenomenon to understand. It has always been hidden, disguised, indirect, Innumerous, severe, carefully conspired and going on for thousands of years. Above all, it’s carefully and forcibly unacknowledged.

Today, it would be seen as ’startling’ and ‘unbelievable’ at the best and outright ‘ridiculous’ and ’scandalous’ at the worst to talk about man’s oppression. It’s not easy to see even the misery and pain of men, even when it is extreme.

It is so well hidden not only from the world but from the man himself. It’s just not acknowledged. No place for it in the society. No value for a man’s tears. Tears are ‘feminine’. The mechanisms of man’s oppression are just as invisible as his tears.

Once you are sensitized and you learn to look beyond what is ‘obvious’ and you slowly start witnessing it all. The first things that point to the size and nature of these invisible mechanisms are the extraordinary and intense pressures that the society (or rather a section of it) exerts to sustain or strengthen the mechanisms.

The masculinity with which boys are born, is natural masculinity. This is given by nature. However, society has created a mechanism whereby it does not acknowledge this natural masculinity. It has instead created its own version, which we shall call ’social masculinity’.

Social masculinity is not naturally endowed, but has to be granted by society. Society does not accept a person as a ‘man’ unless he fulfills certain preconditions of roles or expectations of society, referred to as ‘male gender and sexual roles’, or ’social masculinity roles.

A person is not considered a man without social manhood. This social mechanism is designed to control male behavior, especially male sexual behavior. The result is silent severe oppression of men.

Some of the “Social Masculinity” Roles are:

1. Men don’t have any emotions. They should suppress their emotions and problems.

2. They are rough and tough and should NOT complain about women.

3. Men are expected to be physically tall, strong, and brave.

4. They are supposed to protect and provide women.

5. They are supposed to make sacrifices, even sacrificing their lives, to protect and provide women.

6. They are not supposed to have weaknesses or vulnerabilities. They must not show feelings as these would make them appear weak or vulnerable.

7. They should always be willing to fight their way and defend their families. They should not return from a fight.

8. They should not have any feelings.

The result is that men are far more prone to heart attacks and stroke. Their life expectancy is some 5-6 years less than women, worldwide. Similarly, the social construct of manhood makes them NOT to complain about women, even if their women are causing them grievous hurt!

Women’s education is subsidized and a lot of support systems exist for them to open shop. While men are paying 82% of taxes in India and are denied any kind of support systems. Yet, it is men who are supposed to provide for women. Every year, 3 times more men commit suicide than women and yet there are no support systems or even laws to protect men.

All this is happening in a society that claims to have dumped the earlier traditional roles and concepts of gender and has women working in all fields and having more constitutional rights than men!

It is high time that men are liberated from their traditional roles and their masculinity is redefined based in natural masculinity and NOT with the kind of contradictions stated above. Men have always been considered as disposable and have been taken for granted.

It is high time men understand that are NOT privileged and have been suppressed too!

New Delhi, April 14 (IANS) Guess what? Kerala, Bihar and Chhattisgarh are the states with the highest percentage of women legislators with criminal records while Assam, Jharkhand and Rajasthan are some of the cleanest, says a study.

On the whole, about 13 percent of women legislators in states and 14 percent of women MPs in the 14th Lok Sabha had criminal records, says the study by PRS Legislative Research based on affidavits filed by candidates with the Election Commission up to 2007.

The study by the independent research initiative suggests that women leaders don’t lag behind when it comes to having criminal records or amassing wealth.

A total of 51 women are in the 545-member Lok Sabha while 280 are women among 4,120 legislators across all state assemblies.

The survey shows that 83 percent women legislators have criminal records in Kerala, while the figure is 25 percent for Bihar and Chhattisgarh.

The other states that have women MLAs with criminal records are Madhya Pradesh (22 percent), Karnataka (20 percent), Tamil Nadu (19 percent), Haryana and Orissa (18 percent), Maharashtra and Punjab (17 percent), Uttar Pradesh (13 percent), Andhra Pradesh (eight percent) and West Bengal (six percent).

However, in 11 states, women legislators do not have any kind of criminal record. The states are Assam, Delhi, Goa, Gujarat, Himachal Pradesh, Jharkhand, Meghalaya, Rajasthan, Sikkim, Tripura and Uttarakhand.

The survey names seven women MPs with criminal charges, and topping the list is Bahujan Samaj Party (BSP) chief Mayawati who has in the past been booked for cheating, forgery and criminal conspiracy. She is no longer an MP as she is now Uttar Pradesh chief minister.

There are two from Kerala — the Communist Party of India-Marxist (CPI-M) P. Satheedevi and C.S. Sujatha — booked for unlawful assembly and rioting. Also in the list of women MPs ’with criminal charges’ based on affidavits filed in 2004 is Suryakanta Patil from the Nationalist Congress Party (NCP), accused of misusing a charitable institution.

Two Shiv Sena MPs are there too, Narhire Kalpana Ramesh for wrongful restraint and Bhavana Pundlikrao under the Bombay Police Act.

Women and Child Development Minister Renuka Chowdhury appears in the list for obstructing a public servant in discharging his duties.

Anil Bairwal, national coordinator of the Association for Democratic Reforms and National Election Watch, said he is not surprised by the findings.

’It is easy to see that such women are either the wife or a relative of an influential politician. How did they come on top in politics - by depending on men. In such a situation, it is not surprising to find them involved in corruption or criminal cases,’ said Bairwal, whose organisations work for improving governance and strengthening democracy.

He said a very small number of women are selected by political parties to fight in elections. ’There is no democratic method involved in selecting them. If more women are selected, I am sure they will focus on issues that would make a difference,’ Bairwal told IANS.

The survey also states that many women legislators are richer than their male counterparts. Over 30 percent of women MPs have assets worth more than Rs.1.5 crore. The figure is 14.3 percent for members of legislative assemblies (MLAs).

Similarly, 26 percent of women MPs have assets between Rs.50 lakh and Rs.1.5 crore while the figure is 21 percent for MLAs.

In Himachal Pradesh, most women MLAs’ assets have been put at more than Rs.1.5 crore. ’Three of the five women MLAs in Himachal Pradesh have household assets worth more than Rs.1.5 crore.’

Hi, Rohan, Welcome abroad.

Well first things first,I do not have a maid servant,can’t afford one,so obviously you won’t have the satisfaction of saying ”I told you so” when my non existent maid will not fight an election.

When did I ever mention that I endrose reservation.In fact what I have said is that there should be no reservation because of the present status and furthermore it had made my life hell when I was working.Imagine despite having all the necessary qualification we of general category were always sidelined and had to suffer our juniors becoming our bosses who could not do a single work properly and to be told quite balantly that we would have to complete the leftover work properly.Pretty demeaning.

Who wants reservation for the elite,in fact it should be done away for other reservation also.The tragedy is the people who are really in need almost never get it.

But I have seen people who really deserve and it would really make a big difference in their lives.If they get it I for one is all for women reservation if not the bill should be scrapped at this level itself.No loss to anyone.

I am not referring to your particular case. The educated women in India want it both ways - equality and special treatment. They keep going back and forth between tradition and modernity as and when it suits them. Yes, I agree with you reservation in any form is bad. Hopelessly so. But the reason why those who deserve it never get it is because the people who demand it are always people who never deserve it and they make full use of it. Elite women in parliament are making the biggest noise apart from feminist groups for women’s reservation in the name of poor women in rural areas. None of these poor women would ever stand for elections. Ultimately, these feminist women would do so in their name. Those women would continue to suffer while these women would make hay! The manufacturers of anti-virus software are the biggest manufacturers of virus themselves. Similarly, the women’s rights advocates are the biggest perpetrators of violation of women’s rights as their income is dependent on the sufferings of women. Lastly, please remember that there are deprived men too. Why not reservation for them? [If you support reservation for genuinely deprived women]

Based on that census, The proportion of female population had increased by 0.3 percentage points to 48.4% during 1991-2001.

Total population: 1.064 male(s)/female (2006 est.) This shows a rising trend.. See we are working on it LOL.. No guys in the world can make it to 1:1 LOL .. This is a healthy ratio because that .064 males are supposed to die in the war and at dangerous work locations!

I had been reading Rohan D’s posts and comments here with great interest. I would like to pick up a few extremely valid points that he has arisen here.

It is very sad and unfortunate that the Indian media has been taking the side and promoting the concept of reservation for women without ever, for once, showing the negative side of such a concept.

Completely agree. The media have far realized that to survive and make profit, cater to the tastes of the womenfolk in the households. The ’saas-bahu’ serials not only changed the way what television serials are made these days, but also how ’news’ is disseminated by the tabloid-type so called news channels (almost 100 percent of the Hindi ’news’ channels and 90 percent of the vernacular ’news’ channels).

This is a dangerous trend for the society as it is slowly giving in to the rabid feminists and ’women welfare activists’.

Sadly, whatever credibility is left about the Fourth Estate lies with a few old broadsheets.

Here, when you get married, both sets of parents as well as all the brothers and sisters and friends help the couple out. That way no 1 person is burdened will all the costs. Daughters inherit the same as sons, so there is no reason help one and not the other. Most men are very involved in their children’s lives, from changing diapers, to driving them to school, to helping fix the plumbing after the kid is married. Newspapers never write stories about this, they only write about the bad ones.

There are many truly good men out there and they have the compassion and security in their manhood not to be threatened by the advancement of women. It will be the same there with a little time and patience.

The only thing which is clear is you want Indian women to be stereotyped,an obedient daughter,a docile wife,acaring mother and an adjusting mother-in -law,nothing more and nothing less.

Let me ask you a very very hypothetical question,if any one of your loved one in any of these roles try to break this image and and make a new pathway instead of walking on the one prepared by you will you not allow her?.You will because you love her.

God forbid if anyone suffers or is maltreated would you not stand for her.Women reservation does not consists of elites but there is space for others also and it is those handful of others who will make a difference in the life of others.

Why do women be always been used according to the men’s convinience.remember Laloo when he was unable to become the CM he made his wife occupy the seat and everyone watched the whole drama amused and indulgent.When Pappu Yadav was unable to fight the election he made his wife and mother fight it.In Jaipur also there was a totally unsuitable wife becoming a minister for her husband’s sake.They could not refuse

Women are used as per convinience.There is a maid who works day in day out and when she goes home her alcoholic husband is there to take off her hard earned money and failing he beats her blue and black.

There are females in every sphere of life and some of them really really need reservation of some kind to better their lot even a tiny bit would help.

It would be much better if instead of fighting it out here there should be fight for reservation for females and with inbuilt terms and condtions so that no one takes advantage.

And calling me names would not help because it would do nothing but prevent me posting honst writeups on instablogs which by the way I love doing.

Equality is not one-sided. It is both ways. Women cannot ask for exclusive rights over men in an equal society. Women cannot appropriate the advantages of tradition and modernity. This is unfair to the men! I oppose it tooth and nail! If women have rules created by tradition, men had them too. But now, women are liberated. men are not. men are still in the medieval era protecting and providing women. Women are enjoying the benefits of both systems. I ask you a simple question. How many profiles can you find of women asking for unemployed men? How many women are prepared to pay alimony and maintenance to men? This is exactly the point. 33% reservation for women would open career opportunities for wives and daughters of Laloo and Pappu. Laloo, if I am right, has 3-4 daughters.

Yes, problem exists. I agree. But in the name of these poor maids, Laloo’s daughters would stand for election. Renuka Chaudhary has two daughters - both would be fielded along with the mother. Even if we assume it to be true, it cannot happen in 100 more generations. I absolutely love those long shirts with the pants under them, what are they called? I want to get some of those. I have a couple of sari, they are soooooooo comfortable!
