Rekha is only 16 years old, unfortunately her mental age is even less than that it is near 9. As if this tragedy was not enough she is also an orphan and a inmate of Government run Nari Nikatan in Chandigarh.

Here the poor destitute was raped again and again by a worker named Bhupinder. As per her version, she was taken to the bathroom by another female worker Kamla where Bhupinder used to wait for her and asked her to take off her clothes when she used to refuse to do so he slapped her and forcibly took off her clothes and made her lie down and raped her.

This happened in February and when she was shifted to another home Aashreya Home for the mentally retarded in march she was not keeping well. On her medical examination, she was found to be pregnant. After questioning her the whole sordid story came out. Bhupinder is married with two kids. He is denying his involvement.

With the recent development the Government Officials of the home have gone to the court to take its permission for abortion. There has been a petition from her counsel Tanu Bedi that Rekha should be allowed to keep her baby on humanitarian grounds. As per her plea as Rekha was a destitute she would love to have someone of her own flesh and blood. Even mentally retarded persons have the right to be loved and if a poor woman has a right to give birth even Rekha enjoys the same right.

The High Court has now allowed Rekha to keep her baby. But somewhere this ruling is not totally justified. it is alright for the counsel to make an emotional plea about Rekha wanting to be a mother, but Rekha is not able to look after herself who will take care of the baby. God forbid if even the baby born is mentally challenged like his mother he would be again treated differently.

I know I am being harsh but I am also thinking rationally on this issue. What if during delivery Rekha’s mental condition deteriorates further. Anyone who comes forward to take care of the baby will he or she be able to do so in future also. In some cases it is proper to think rationally rather than emotionally.

How can the court give such a judgment. The girl can't look after herself and court allowed her to be a mother. The court can't decide merely on the basis of emotions.

According to the story her mental age is nearly 9 years. I doubt if she know any thing about the becoming of a mother.

History repeats…. probably Rekha is the result of a wrong decision my mother....and left her in the orphanage, mostly probably this child will also end up in a orphanage...

Indian courts have always failed in giving proper judgment time and time again. I read the article about her this morning and was shocked at the court’s decision. It’s really sad to think that a mentally 9 years old girl has to care for a baby when she herself is a baby. The culprits should be given the harshest punishment for what they did to her.

Even I am of the same view that when the girl is not able to take care of herself howcan she take care of an infant who will demand 24X7 attention.Logically and rationally this judgement is not correct.Emotional pleas have turned the tide in her counsel’s favor without any concrete thought being given to the future of either the mother or the child.

Court’s judgement is nothing buta result of poor logic.The court needs to show farsightedness in its judgement.First of all there should be proper trial of the rape accused.It is the only justice that Rekha needs.

It's the tragedy with Indian Judiciary that it lacks farsightedness. You are very right that there is need of proper trial in this case but media has diverted the people's attention from the main issue. Why the girl is facing such a situation?
